The International Metal Workers&rsquo; Federation (IMF), in collaboration with the ITUC and other Global Union Federations, last week announced the third annual Geneva Labour Film Shorts Festival, to take place 16 June 2009. The event will &ldquo;explore ways of reaching broader audiences and promote and support the capacity of trade unions to communicate through film.&rdquo; 
 
Started in 2007 as part of the IMF Communicators&rsquo; Forum, the Geneva Labour Film Shorts Festival has grown over the last two years and has positioned itself as one of the only international film festivals to showcase primarily film and videos made by unions about unions and working people. 
 
The three-hour programme will focus on films that are excellent examples of communicating labour stories and messages and the selection will include a range of different films from different parts of the world. 
 
The IMF asks for copies of films, in English, on DVD with a short paragraph describing the film and why it was produced, by 13 February 2008. Third Annual Geneva Labour Film Shorts Festival Announced

ICEM General Secretary Manfred Warda compared the labour repression of the Mexican government to that of the regimes in Burma and Zimbabwe. This follows the recent arrests of two union officials and the seizure of the union&rsquo;s bank assets. 
 
The targeted National Miners&rsquo; and Metalworkers&rsquo; Union of Mexico (SNTMMSRM) is fighting to retain its democratic integrity as a trade union in Mexico. 
 
The recent arrests were clearly carried out on the request of Grupo M&eacute;xico and other employers. The ICEM points to reports that arrests of other trade unionists are imminent. The letter can be found <a href="/sites/default/files/migration/icem/0812.President%20Calderon.pdf">here</a>.

The two union leaders, Carlos Pavon Campos, SNTMMSRM&rsquo;s secretary of Political Affairs, and Juan Linares Montufar, president of the union&rsquo;s General Council of Oversight and Justice, are accused of stealing funds awarded the union after the privatization of Grupo M&eacute;xico&rsquo;s Cananea copper mine, according to Mexico&rsquo;s top prosecutor. Mexican miners at numerous sites laid down their tools in protest against the arrests, including Fresnillo, Madero, and Sabinas worksites, demanding the immediate release of the two. 
 
The illegal arrest of Juan Linares was carried out at his home on 3 December, with a heavy presence of federal and state forces. The equally arbitrary and illegal arrest of Carlos Campos came the following day, with Campos being taken to the Camarones detention centre. 
 
These repressive actions of the Mexican government continue a worrying trend of the last three years, which has seen SNTMMSRM&rsquo;s General Secretary Napoleon Gomez Urretia twice removed from office, and other union officials charged falsely, with several of those charges dismissed in court rooms.

ICEM Condemns Union Repression by Mexican Government

On 11 December, ICEM General Secretary Manfred Warda met with Argentine affiliates in Buenos Aires. The meeting was held with the support of Friedrich Ebert-Siftung (FES), a German-based labour foundation. It included unions representing paper workers, private-sector energy and gas workers, and others. 
 
Manfred Warda welcomed to the meeting the metal workers&rsquo; union of Argentina, a union seeking affiliation to ICEM on behalf of nuclear energy workers.

The meeting focused on recent ICEM initiatives, with attention to what is planned and occurring in the Latin American/Caribbean Region. Issues regarding energy and the different networks that operate with regional involvement in energy and chemicals were of special interest. The participants of the meeting voiced their concerns on contract and agency labour, and sustainable development. Gender and youth issues were other focuses. 
 
Warda expressed gratitude that the Argentine affiliates are prepared to welcome the next ICEM Congress in 2011. The Congress will be a resounding success, not least because of the enthusiasm shown on the part of Argentine affiliates.

ICEM Convenes Meeting of Argentine Affiliates; Agreement on 2011 Congress in Buenos Aires

Pulp and Paper trade union leaders of the ICEM concluded their World Conference on 10 December in Piri&aacute;polis, Uruguay, with delegates forging a clear and concise solidarity action plan. With that, ICEM&rsquo;s Pulp/Paper Work Group activities will be extended and expanded to other leading affiliates. 

The conference featured a work plan, built around collective bargaining and other important work, and it took on issues of debt collapse, global growth slowdowns in the south, and pricing and labour costs from region to region.

The conference heard a thorough and first-of-its-kind mapping of Mercosur unions in the pulp and paper sector and the companies that these unions are present at. The mapping came way of Brazil&rsquo;s Instituto Observat&oacute;rio Social, through funding from Finland&rsquo;s SASK, the global solidarity arm of the country&rsquo;s national labour centre. 
Delegates heard comments from Argentine trade union leader Blas Juan Alari, President of FOEIPCyQ, that a cold-war dispute between Argentina and Uruguay over a pulp mill did not take into account the sentiments of Argentine workers. The conference also heard moving presentations about workers&rsquo; rights in Uruguay from leaders of the national labour centre, PIT/CNT. 
They also heard from Ilkka H&auml;m&auml;l&auml;, President and CEO of Metsa-Botni&auml; Oy, whose pulp mill in Fray Bentos has brought controversy between Argentine and Uruguyan governments, and from Jeronimo Ruiz, Director of S&atilde;o Paulo State&rsquo;s BRACELPA employers&rsquo; grouping, who also heads collective bargaining for Brazil&rsquo;s pulp and paper employers. 
Workers&rsquo; representatives queried the industry leaders on several things, including wood supply issues; pulping, delivery, and labour costs, and questions on social responsibility records, a sharp challenge that was put forward by ICEM Pulp and Paper Charman Jouko Ahonen, President of Paperiliitto of Finland. He said the precedence of profits to investors over society&rsquo;s interests is the foremost affront to a company&rsquo;s social responsibility record.

The conference also heard from Uruguay Industry and Energy Minister Daniel Martinez and Labour and Social Security Minister Eduardo Bonomi. Martinez, a former trade union leader in Uruguay, gave an impassionate speech on the need to uphold high labour and social standards in all industrial development. Bonomi gave a vivid account of a crumbling civilian government giving way to military in the 1970s and 1980s, as well as proclaiming that Uruguay&rsquo;s cuurent plans for industrial growth will better integrate the Mercosur countries. 

President of the host union, CUOPyC&rsquo;s Walter Silva, reminded trade union guests that any financial crisis inevitably harms workers first and the hardest, and said the most recent economic collapse must be the call for deepening democratic trade unions, opening of workers&rsquo; channels to investment decisions, and an absolute end to &ldquo;any type of social dumping.&rdquo; 

Silva also called the Argentine-Uruguay dispute &ndash; now in the World Court &ndash; regrettable, stating &ldquo;our opinion wasn&rsquo;t taken into account, although we had the ability to offer experience and knowledge&rdquo; to calm the political difficulties of the Fray Bentos mill. The mill has now been operating for one year and produces 100,000 metric tonnes of pulp annually, 70% of which is bought by Metsa-Botni&aacute;&rsquo;s three paper-making owners. 

ICEM General Secretary Manfred Warda told delegates the neo-liberal model of economic structures has failed. &ldquo;It is not a time to heal a system that has failed, but rather a time to forge a sustainable future built on justice and equality.&rdquo; 

He said Uruguay was the right place to hold this conference, considering the dark days of repression in the 1970s and 1980s, with the ICEM purposely scheduling the conference on the 60th Anniversary of signing of the Universal Declaration of Human Rights. 

The three-day ICEM forum was preceded by a two-day conference, 6-7 December, on forest certification programmes sponsored by the global union federation, Building and Woodworkers&rsquo; International (BWI). That forum proved highly successful and afforded.ICEM affiliates the opportunity to learn about forest certification programmes.

ICEM Pulp/Paper Conference Held in Uruguay

On 1-2 December, in Bogot&aacute;, Colombia, union leaders of ICEM affiliate Sintracarb&ograve;n delivered a list of demands to management of Carbones del Cerrej&oacute;n, the world-class coal mining operation owned by BHP Billiton, AngloAmerican, and Xstrata. The workers are seeking solutions regarding serious problems in health, education, low wages, outsourcing of labour, and effects on the local community. 
 
Preliminary discussions were carried out on 3-4 December at company headquarters in the city of Barranquilla, where a course was set forth for the negotiations to continue. The direct settlement stage of discussions began 9 December, where both parties again agreed on the required methodology in approaching negotiation of the union demands. 
 
This massive open-pit mining enterprise in the northern state of Guajira produces highly desirable low-carbon thermal coal. The mine produces 32 million tones annually, with a majority of that shipped to Europe, with exports to North America second in scope.

Since January 2007, when the ICEM assisted Sintracarb&ograve;n in achieving its current and now expiring labour contract, the number of health problems of workers has increased dramatically, up to 700, leading to the demand for a better health care system for both workers and their families. Aims to reduce the numbers of outsourced workers at the mine would develop economic stability for miners and their families, as well as efficient unionization of the workforce enabling collective bargaining. 
 
The union represents some 4,500 full-time Carbones del Cerrej&oacute;n workers, with another 4,000 employees working for service providers. Sintracarb&ograve;n is requesting solidarity again from its global affiliation, as well as from national level unions in Colombia as the talks progress in December.

Sintracarbòn Enters Critical Talks with Carbones del Cerrejon in Columbia

ICEM Director of Industry and Corporate Affairs Joe Drexler reports that progress is being made with Russian and Ukrainian governments by ICEM-affiliated mining affiliates in promoting the ratification of the ILO Convention 176 on Health and Safety in Mines. 
 
Russia experienced a major mining disaster last week when 12 people were killed at an apatite mine near Kirovsk, in the Murmansk region, and Ukraine has the most dangerous coal mines in Europe. Apatite is used in fertilizer production. 
 
In a week-long trip that included stops in Moscow, Russia, and Kiev and Donetsk, Ukraine, Drexler met with union leaders, employers, and government officials including the Deputy Minister of Health and Social Development in Russia and the Minister of Coal in Ukraine. The meetings with the ministers were set up by Ivan Mokhnachuk, President of the Russian Independent Coal Employees&rsquo; Union, and Victor Turmanov, Chairman of the Trade Union of Workers&rsquo; of the Coal Industry of Ukraine.

In Russia, the Chemical and Allied Industries Workers Union, which represents some 50,000 largely phosphate and potash miners, and the Russian Trade Union of Metal Workers in the Nickel, Cobalt, and Platinum Industries, representing miners at Norlisk Nickel, offered strong support for the ratification of ILO Convention 176. Valery Glaskov, president of the metal mining union, also said he would open direct talks with Norlisk about a Global Framework Agreement. The talks will include the ICEM and trade unions outside of Russia. Norlisk has mining operations in Africa and the US.
It is in Ukraine where the prospect of achieving ratification of ILO Convention 176 in the near-term appears most likely. Victor Turmanov, who is also a member of the Ukrainian Parliament, has been leading the effort along with Mikhail Volynets of the ICEM affiliated Independent Trade Union of Miners of Ukraine, and also a member of Parliament. A meeting was also held with Vasyl Khara, President of the Federation of Trade Unions of Ukraine, and yet another member of Parliament. Although much of the research and proposed changes to mining laws and regulations have been prepared, unified political pressure will be required to ensure ratification. 
&ldquo;I think we can say with confidence that Ukraine will become the 23rd nation to ratify ILO 176,&rdquo; said Turmanov after a meeting with Viktor Poltavets, the Minister of Coal, who gave his whole-hearted commitment to push for ratification in 2009. 
 
The ICEM has been lobbying the ILO to step up its own efforts to promote the ratification of the convention. The ILO is setting up workshops about ratification in India and Mongolia, but after several months of discussion, no meeting dates have been set. 
 
Indian unions have grown frustrated over the slow progress by the ILO and are actively engaged in lobbying efforts with government and employers. The Construction, Forestry, Mining, and Energy Union (CFMEU) of Australia has received a commitment from the new Labour government that it will also proceed next year toward ratification. 
 
Ratification of ILO Convention 176 will result in needed improvements in mining regulations and laws in most countries which have not yet ratified. Experience has shown that good mining laws and regulation will make mines safer.

ILO Mine, Safety Convention 176 Moves Closer to Realty in Russia, Ukraine

A critical meeting was held in Basra at the headquarters of the Federation of Workers&rsquo; Councils and Unions in Iraq (FWCUI) on 29 November. Iraqi union leaders of FWCUI&rsquo;s branches met in a general session with an emphasis on preparing for elections in the oil sector. 
 
The meeting was attended by 36 trade union leaders of the oil sector, including workers&rsquo; representatives from the northern Rumaylah fields, the southern Rumaylah fields, as well as the Birjisiya, Shiayba, and Saltt stations, the pipelines company, the petrochemical company, and the headquarters unit of the Southern Oil Co.

The meeting was chaired by Thair Ismaieel, coordinator of FWCUI&rsquo;s preparatory committee, and was attended by Raiad Mahmoud and Haydar Abd Alilah, charged with administrative and financial affairs, for the union, and by Kareem Johi, Secretary of FWCUI&rsquo;s Petro-Chemicals Branch. 
 
The meeting produced a set of recommendations intended to determine responsibilities of the union&rsquo;s supreme committee regarding elections, and a call to respect the instructions issued by this committee. 
 
The recommendations also include mechanisms to empower union members to shape the federation as an independent organization, to encourage women to join unions of the federation, a call to unionists to be willing and able to support workers&rsquo; activities in all sectors, and publishing and distribution of FWCUI&rsquo;s newspaper in all workplaces. 
 
The meeting took up the challenges to the 1987 Saddam-era Decree 150 &ndash; still in force &ndash;which prohibits independent trade unions in the public sector, and also explored ways to expand membership. FWCUI is focused on making its unions power tools in the hands of workers.

A week after the meeting, on 5 December, FWCUI issued a strong statement against the so-called &ldquo;Security Agreement&rdquo; between the US and the government of Iraq. That statement rejects the agreement and invites other Iraqi parties that reject the agreement &ldquo;to place their opposition in the political arena (in order) to widen the public discourse and to transform the rejection of this agreement to an empowerment of the people.&rdquo; 
 
FWCUI members of the supreme committee for elections includes: Thaier Ismaieel, President; Mustapha Ahmed and Mahdi Bishara, Vice Presidents; Raid Abd Alqader, Secretary; Ghazi Abd Alqader, Secretary Assistant; Dhaher Auda, Administrative and Financial Affairs Officer; Nashwan Faisal, Administrative/Financial Assistant; Kareem Johi, Communications Officer; Mukhlis Faisal, Public Relations Officer; and Saffa Talib and Muayad Hamad, respective assistants in those latter areas.

FWCUI in Iraq Holds Crucial Meeting Leading Up to Elections

The ICEM fully supports the work of the National Federation of Food, Beverage and Tobacco Workers of Pakistan, an affiliate of the International Union of Food Workers&rsquo; Association (IUF). The 723 contract labourers at Unilever&rsquo;s last directly-owned and operated Lipton Tea factory in Pakistan have organised to form the Unilever Mazdoor Union Khanewal. The newly organised workers, with the support of the IUF and ICEM, are preparing a new round of public action to press their case. 
 
The ICEM and IUF call for international support for the cause of these contract workers to form their union. To support their struggle click <a href="http://www.iuf.org/cgi-bin/campaigns/show_campaign.cgi?c=396">here</a> to send a message to Unilever. Tell corporate management that the Lipton Khanewal temporary workers must be given permanent employment status - and the way to implement this is through direct negotiations with the affiliated National Federation of Food, Beverage and Tobacco Workers of Pakistan. 
 
Unilever's Khanewal factory employs 22 permanent workers, union members who are covered by a collective agreement. But another 723 workers are hired through six contract labour agencies. The union is assisting contract agency workers to file petitions in the Labour Court to secure their right to permanent employment.

The permanent workers receive a monthly base wage of PKR 18,000 - some US$226. The basic wage for non-permanent workers is PKR 6,000, if they are lucky enough to work a minimum 26 days per month. Otherwise the daily wage is PKR 232 - less than three US dollars a day. Where permanent workers receive double for overtime/holiday work, agency workers simply receive the basic hourly wage. Disposable workers have no annual or medical leave. From one week to the next, they do not know their assignments or work schedules - or whether they will have work. Through exploiting workers in this way, Unilever was able to send CEO Niall Fitzgerald into retirement with a &pound;17 million golden handshake. 
 
Unilever employees at the site are illegally blocked from becoming permanent workers, as national legislation states that after nine consecutive months employed under a temporary contract, an employee must be offered a permanent contract to stay. The majority of agency workers at the Khanewal site have been on the job for more than 10 years, with some there for as long as 30 years. But since they are not formally employed by Unilever, they are barred from joining a union of Unilever workers and bargaining with Unilever as their employer. The labour agencies who supply the temporary employees to the factory do not have any other client, and operate their offices inside the Unilever factory itself, clearly a false way of flouting labour law. 
Two Lipton workers dismissed in August after 30 years of working at Unilever's Khanewal tea factory at minimum wage and received no social security, medical benefits or pension.

The Lipton workers are fighting for the right of workers everywhere to decent work - secure employment, a living wage, health and retirement benefits, and the right to join a trade union with a collective bargaining relationship to their real employer.

Motion on ICEM Project work 
ICEM Executive Committee, June 2008 
 
Whereas it is acknowledged that there is a need for a clear, transparent and open ICEM policy in regard to ICEM projects and ICEM project related activities; 
 
Whereas, due to the global structure of the ICEM, the number of affiliates in need exceeds the number of affiliates that are able to offer structural assistance. 
 
Whereas it is commonly known that the expectations and demands of affiliates for international support action exceed the services that the ICEM can provide to its affiliates as a global union organisation, working only through income from affiliation fees; 
 
Whereas it is recognised that there is a wide array of possible external funding organisations, ranging from traditional donor organisations, usually trade union organisations themselves, or organisations set up by unions, over union-friendly and/or union-related organisations and governmental, or government-related, organisations, to companies and/or corporate or employer organisations; 
 
Whereas project related activities can consist of ICEM-organised activities and programs through extra-budgetary funding, as well as through in-kind contributions by external organisations; 
 
Whereas there is a need, given the envisaged closer cooperation of ICEM with other Global Union Federations, in particular IMF, ITGLWF and BWI, to also recognise their work, specific experience, and objectives in the area of project work; 
 
Whereas projects are expected to contribute to the general development aid objectives of creating world-wide justice and equality, concentrating especially on decent work, trade union building, the strengthening of unions at national level, as well as on the strengthening of international mutual support at the regional and global level, 
 
Whereas the ICEM, as part of these discussions, decided at its Executive Committee meeting in Bangkok, in November 2007, on a list of activities that should be given priority in 2008/2009; 
 
 
There is need for a regular evaluation of ongoing projects in regard to targets set, as well as for a timely discussion on future activities; 
 
Linked to the above, good and regular follow-up and input from ICEM affiliates is required, including at ICEM-meetings at regional and international level; 
 
It is recommended that the internal debate in the ICEM should be based on the principles, views and objectives listed here below. 
 
 
The ICEM considers project work, where well chosen and effectively managed, to be a strategically important addition to the regular day-to-day activities of the ICEM; 
 
ICEM project work should concentrate on assisting those in need and those that need our international assistance the most. This issue does not only need to be looked at from a geographical angle. To some extent, sectoral issues also come in to play. The mining sector is an example of an area with, on the one hand, a great deal of activity in developing countries, and, on the other, a decreasing membership base in the majority of the OECD countries. 
 
The ICEM continues to believe that project work should be an integral part of the normal national and international daily trade union activities. Project work will be planned with links to, and in support of, other ICEM day-to-day work, or otherwise contribute directly to the main ICEM goals. In addition, and in return, the aim should be that where a donor funds a particular project, it gets the assistance of the whole international organisation; 
 
Projects will therefore be selected, chosen and agreed upon, on the basis of their capacity to advance the realisation of key ICEM priorities, especially those set at ICEM Congresses; 
 
Project work can be used, as long as it is linked to the ICEM&rsquo;s key priorities, to realise both the organisation&rsquo;s overall general global main objectives, as well as certain specific, at times, detailed goals; 
 
The ICEM believes that its work can not only greatly profit from cooperation with the traditional, trade-union-friendly solidarity support organisations (SSOs), but also from cooperation with other donors, including private/public partnerships, provided the integrity and independence of the ICEM as an international trade union organisation is not compromised; 
 
The ICEM does recognise, nevertheless, that there is a need to continue to monitor, at all times, the risk to become too dependent on external funding. Internal assessments shall therefore be made, including through appraisals on a continuous basis; 
 
Wherever possible, project work will make an effort to simultaneously advance different ICEM priorities. Particular emphasis in social dialogue, or framework agreement discussions, for example, could go to such ICEM key issues as contract and agency labour, HIV/AIDS, or health and safety. Reinforcing unions through improving negotiations skills on these issues, as a union-strengthening effort, is a similar example; 
 
It is agreed that the following are among the most important priorities for ICEM project work: 
 
&bull; The strengthening/modernisation of trade unions continues to be a high priority for the ICEM. Many of our affiliates still are in need of external and international assistance. Indeed, many affiliates identified this kind of solidarity as an important contribution to become equal partners to the world&rsquo;s (multinational) companies, as well as to their governments. Related to this is the continued need, within numerous affiliates, to improve internal structures, and to train union leadership, shop stewards and trade union members on a range of subjects, from basic trade union issues, over international economy and international trade union rights, to globalisation issues and ways to deal with multinational companies. Examples of specific subject matters include International Financial Institutions, Global Framework Agreements, ILO standards and the OECD Guidelines for Multinational Enterprises; 
 
&bull; Of specific importance for project work in this area is the need to build strong branch or industrial unions, at national and/or regional level. Many affiliates use this project support to move away from company unionism; 
 
&bull; Linked to the above is the need for union consolidation at national level. In too many cases, unions are in competition with each other at national level, and, as a result, not strong enough to bargain effectively with their employers; 
 
&bull; Defending basic trade union rights, and fighting violations thereof, also continues to be an essential part of project work, albeit to various extents, depending on national situations and practices; 
 
&bull; The work on multinational companies is one of the major focal points of the ICEM&rsquo;s project work. The many priorities here include work and discussions on global framework agreements and, most certainly, international company networks, which already centre prominently in the ICEM&rsquo;s current project work. The setting up of such international networks for ICEM affiliates and their members, working with and for the same multinational company, or within the same industry, has proven to be a valuable tool for workers and is widely seen, for various reasons, as one of the main achievements within the ICEM&rsquo;s project work; 
 
&bull; A key priority in the work with MNEs, but also with other companies, is the issue of social dialogue. The ICEM will give priority to projects that deal with this issue. Not only as they are in high demand, but also as this is an area where the ICEM has a good and longstanding expertise, and because it is an area where the organisation can make a difference. Closely related to social dialogue, collective bargaining, and improvements thereof, also remains a highly important priority within the ICEM&rsquo;s project work; 
 
&bull; Another key aspect, and obvious necessity in relation to multinational companies, but also beyond, is the organising of new members. Almost all ICEM projects already support organising efforts; 
 
&bull; The issue of contract and agency labour &ndash; unquestionably one of the key threats currently for not only the ICEM, but also many other global union federations, as well as countless unions around the world &ndash; is not only an important factor in our strengthening-of-unions exercises, it also plays a vital role in the ICEM&rsquo;s work vis-&agrave;-vis multinational enterprises; 
 
&bull; The work on HIV/AIDS will also continue to be a key project priority, given the success of the current HIV/AIDS project. This can not only be measured by the goals it has already achieved, but also because of the positive effects it has in attracting lesser-traditional funding in this area; 
 
&bull; The gender dimension is a central part of all ICEM project work. This work includes efforts to look at how to better involve women in union work, and improve their participation in leadership structures; 
 
&bull; Health and safety also remains a priority for the ICEM&rsquo;s project work, including as a topic for international social dialogue. Health and safety in the mining sector is a concrete example of an issue where the ICEM could be highly instrumental in making further progress at the international level. Project activities should, where possible, support the ICEM&rsquo;s campaign to sign on to the principles of the ILO Convention 176 on health and safety in mining; 
 
&bull; Linked to the work on health and safety is the subject of sustainable development, an subject matter that is increasingly gaining in importance, not only in project-related work. On a slightly different level, but also related to the sustainability effort is the work on corporate social responsibility; 
 
&bull; As, of course, not all multinational companies are equally looking forward to working with the international trade union movement, failed efforts to establish a meaningful and positive social dialogue can, and in many cases, should be offset by corporate campaigns, which can also be a substantial part of project work; 
 
&bull; Finally, particular emphasis will go to the problems of trade unions in those regions and countries that were given priority in the most recent set of ICEM Congress resolutions, such as the Middle East, Iraq, Burma, Colombia, Palestine and Zimbabwe.
