	The threat of strikes across Austria&rsquo;s electric energy sector in mid-February brought a national labour agreement to 21,000 workers. ICEM affiliate PRO-GE and GPA-djp, the Salaried Employees, Print, Journalism, Paper Union reached accord on 12 February after the third round of bargaining last week failed.

	In keeping with a decision made in worksite meetings after the second round of talks failed, late in January, the two unions got strike endorsement from the Austrian Federation of Trade Unions (&Ouml;GB) and were to start manifestations today, with warning strikes commencing tomorrow.

	Instead, the employers&rsquo; association moved a previous 3.6% wage offer to over 4%, with the minimum level of wages in the utility sector lifted to 4.2%. Higher-level wages will be increased by 3.8%, while those of apprentices will be hiked by 4.2%.

	The two unions took the stalemate in 2012 wage negotiations to union memberships at the shop-floor level because employers were refusing to come close to wage level increases reached in Austria&rsquo;s metal sector last October, or to account for a 2011 inflation rate of 3.2% that continues to rise. The unions also cited rising company earnings as reason why electric generating and distribution companies could pay what was achieved in the nation&rsquo;s metal sector.

	In a statement issued yesterday, PRO-GE&rsquo;s Manfred Anderle and GPA-djp&rsquo;s Karl Proyer jointly said: &ldquo;Our great thanks go to all employees and to the shop stewards, who made this possible through their solidarity and readiness for action.&rdquo;

Strike Threat in Austria Brings National Electric Accord

	From Seoul to Pretoria, Geneva to Mexico City, unions are taking joint action during the week of 19-25 February 19-25 to urge the government of Mexico to stop its attack on independent trade unions and freedom of association.

	International mobilizations kicked off in the main square of Mexico City on 19 February, in remembrance of 65 miners who died in the Pasta de Conchos mine explosion on that date six years ago. On 21 February, actions took place in Mexico, Geneva and London.

	And the United Steelworkers (USW) used the eve of the Week of Action to again condemn the actions of Canadian mining company Excellon for its damaging behaviour in Mexico.&nbsp;Excellon&rsquo;s only Mexican operation, the Platosa mine, brings problems for workers, landowners, and the environment.

	The Tri-National Solidarity Alliance, which joins unions from Canada, Mexico and the US held a meeting of Solidarity at the headquarters of the Mexican Electricians Union (SME) in Mexico City.&nbsp; Speakers at the event, including IMF Executive Committee member and exiled leader of the National Union of Miners and Metal Workers of Mexico (SNTMMRM) Napole&oacute;nG&oacute;mez (via video conference), denounced the Mexican government&rsquo;s attacks on fundamental workers&rsquo; rights and called for the implementation of ILO recommendations adopted by the Governing Body in March 2011.

	In Switzerland, a group of 20 ICEM, IMF, UNI and IUF activists held a small action outside of the Permanent Mission of Mexico to the UN in Geneva. Manfred Warda, Jyrki Raina, Philip Jennings, Fernando Lopes, Kemal &Ouml;zkan met with Mr. Juan Jos&eacute; G&oacute;mez Camacho, Ambassador to the Mexico mission.

	Discussions between the Norwegian Foreign Ministry and trade union Fellesforbundet are underway ahead of a planned visit to Mexico by the Foreign Ministry later this month. The union has been briefing Norway&rsquo;s government on the issue of Protection Contracts in Mexico and the ongoing attacks on fundamental worker freedoms.

	Mexico&rsquo;s Embassy in London met with a delegation from the Trades Union Congress (TUC), and unions Unite and GMB, and Amnesty International and the Southern and Eastern Regional TUC on 21 February. Similar actions are planned for major cities in the US, including Chicago, Tucson, Boston and Denver, and in Korea, Pakistan, South Africa and Canada.

	Unions around the world are also supporting the global action by sending protest letter to the Mexican government in care of their respective embassies and consulates.

Week of Action Again Shines on Mexico’s Trade Union Abuses

	Job security and job creation was the foundation behind a new two-year national labour agreement between social partners in Denmark. That came together in marathon bargaining over the weekend, 11-12 February, in framework talks for 240,000 Danish manufacturing workers and 6,000 enterprises, the latter represented by Dansk Industri.

	The trade unions, led by the eight making up Co-Industri, including 3F, Dansk Metal and HK/Pivat, in concert with the Danish Confederation of Trade Unions (LO), set an agenda of wage moderation, instead focusing on winning excellent and precedent-setting job preservation protections such as training, seniority, and reduced work hours at full pay for both old and young workers.

	This industrial social accord now establishes the parameters for other work sectors. The agreement will run from 1 March 2012 to 1 March 2014. The national industrial agreement did establish minimum wage guideposts, but exact wage increases will now be negotiated at local levels and inside company agreements.

	The framework agreement grants training at full pay with business downturns and when reductions in work time occur, and it also allows older workers to reduce their working time within five years of retirement by continuing their income levels through salaries and partial pension benefits. Workers will also have the option to tap into current pension plans as a supplement to salaries.

	A key element in the new agreement is an additional &euro;.05-per-hour worked will be added to the national Industrial Training fund.

	Employee discretion in taking training options increases from two weeks to six weeks, in some cases, and full seniority is granted to workers when they are called back from lay-offs within nine months. Previously, it was six months. As well, paid sick leave occurs after six months on a job rather than the previous nine months.

	The new pact is also kinder to lower-income earners and gives better pay-outs when such workers are laid off. Parental leave was made more flexible and added pension accrual was put in place for weekend, holiday or extra work performed.

	The recommended minimum wage increase is &euro;.18-per-hour effective 1 March, and the same amount again on 1 March 2013. A pay supplement of 1.4% each year is available for performing difficult work, and apprentices, trainees and interns will get a 2.25% pay hike in each year.

	The bargaining, which began in early January, nearly reached dispute when HK/Privat , the Commercial and Clerical Workers&rsquo; Union, sought to drop the 50% benchmark regarding number of staff needed before a collective agreement takes effect. A compromise was struck that gives employers the opportunity to sign labour agreements without the 50% threshold and HK/Privat coverage also was expanded to include administrative staff working as trainees and college students.

	The agreement was widely praised in Denmark as the necessary building block to restore some 80,000 industrial and manufacturing jobs that have been lost in the country since the onset of the financial crisis.

Danish Industrial Contract Gives Job Security Prime Seating

	Locked-out members of Syndicat des M&eacute;tallos &nbsp;d&rsquo;Alma Local 9490, the United Steelworkers (USW), took their fight against Rio Tinto Alcan to Qu&eacute;bec&rsquo;s largest city, last Friday, 17 February, where Alcan CEO Jacynth C&ocirc;t&eacute; was part of a spurious forum on youth in employment, sponsored by the Board of Trade Metropolitan Montr&eacute;al.

	Some 200 of 780 metalworkers from Alcan&rsquo;s Alma aluminium smelter in the Saguenay-lac-Saint-Jean region, Qu&eacute;bec, boarded buses and travelled 460 kilometres to Montr&eacute;al for a noisy protest at this business luncheon, their first manifestation away from the 488,000-tonne-per-year smelter. They were joined by another 100 steelworkers from Montr&eacute;al, and some 100 college students who joined the USW rally in mocking protest to a future of youth theme that now sees business teaming with the Liberal provincial government of Qu&eacute;bec to raise their university tuition fees.

	This &ldquo;Hot Issues@Lunch&rdquo; theme was billed to &ldquo;foster the success of the next generation of Qu&eacute;becers.&rdquo; &nbsp;&nbsp;The Syndicat des M&eacute;tallos d&rsquo;Alma found deep irony in Jacynth C&ocirc;t&eacute; participating, since Alcan in Alma is using a lock-out to replace C$36-an-hour permanent jobs with outsourced and presumably younger workers at C$16-an-hour.

	C&ocirc;t&eacute; was not expected to address the lockout at the hot-plate lunch, but when pressed by reporters on the sidelines, she called the dispute a &ldquo;regional issue&rdquo; and &ldquo;it will be settled in Saguenay-lac-Saint-Jean&rdquo; by managers who &ldquo;have my full confidence.&rdquo;

	Earlier last week, when the lockout entered week seven and with the remote mining and manufacturing region starting to feel the economic effects of a lost wage base, one such manager told Reuters he &ldquo;wouldn&rsquo;t put a timeline to (talks restarting) right now because nothing is scheduled.&rdquo;

	With aluminium prices hovering now at very low, the Alma lockout serves as a convenient strategy to restrict supply to lift prices. It also fits Rio Tinto&rsquo;s strategy of divesting and devaluing Alcan by C$8.9 billion in view of its US$39 billion purchase of the Canadian company in 2007, although the modern and high-tech tooled Alma smelter, with its low-cost hydroelectric supply, will not likely be jettisoned.

	Perhaps this should have been a more apt business theme to the Board of Trade elite last week, and it certainly best explains the anger of metalworkers and students alike gathered on the other side of the barricades. In this vein &ndash; with Rio Tinto&rsquo;s share price dropping &ndash; it is worth mentioning that C&ocirc;t&eacute; herself exhibited a timely corporate mentality last week by shedding 3,671 shares of Rio Tinto to pocket US$213,500, money not likely to find its way to Saguenay-lac-Saint-Jean.

	USW District Five Director Daniel Roy addressed the disparity between full-time, family-supporting jobs in the region to the sub-contract and lower-wage jobs that Rio Tinto is trying create with the. &ldquo;Accepting this would cause a dramatic downward spiral not only for the workers but for members of the community, which would see income, local business sales and tax revenues drop precipitously.&rdquo;

	USW Local 9490 President Marc Maltais added, &ldquo;By using subcontractors to do the work of union members, we are asked to concede on behalf of future generations. This is an attack on our children and grandchildren.&rdquo;

	The buses departed Montr&eacute;al late on Friday afternoon for the return trip to Alma, but first stopped at a plant-gate demonstration in Sorel, Qu&eacute;bec, where workers and members of ICEM-affiliated FIM-CSN (Conf&eacute;d&eacute;ration des Syndicats Nationaux) at a Rio Tinto Iron and Titanium metal powders plant lent their support. This stop again depicts the long-erected barriers between Canadian trade unions that Local 9490 are erasing inside this lockout.

	With Canada currently undergoing an unprecedented rash of corporate hostility, it is notable to witness trade unions and other groups galvanising behind victimised union workers.

	Last week, members of Canadian Auto Workers (CAW) Local 2301 at a Rio Tinto Alcan aluminium smelter in Kitimat, British Colombia, voted to take C$1-an-hour of their pay and donate it to &nbsp;Syndicat des M&eacute;tallos&nbsp; d&rsquo;Alma Local 9490. That represents C$60,000 per month.

	On 8 February, the Communications, Energy, Paperworkers (CEP) Union of Canada contributed C$25,000 to the Alma metalworkers, and a day later the Canadian Union of Public Employees (CUPE) contributed C$10,000. USW Local 9700, one of the first unions to respond at the time of the 30 December lockout and representing Alcoa ABI workers at B&eacute;cancour, Qu&eacute;bec, voted unanimously to draw C$25-per-week from their paychecks, donating C$25,000 weekly to Local 9490.

	Syndicat des M&eacute;tallos&nbsp; d&rsquo;Alma&rsquo;s&nbsp; journey to Montr&eacute;al to confront Rio Tinto Alcan CEO Jacynth C&ocirc;t&eacute; is just the first sally outward. This week Local 9490 leaders will visit Rio Tinto&rsquo;s borax miners in California, where members of ICEM affiliate International Longshore &amp; Warehouse Union (ILWU) Local 30 defended themselves courageously in a Rio Tinto-imposed lockout. And they&rsquo;ll follow that solidarity visit with to Australia to meet with unions represented Rio Tinto there.

	On March 31, a day after the ICEM North American region meets in Alma, a manifestation will occur there with scores of global trade union leaders attending. And on 1 April, a workshop will occur in Alma to verse an exact fightback strategy against Rio Tinto on the global level.

Locked-out Alcan Workers Take Dispute to Business Doorstep

	Some 250 European trade union militants turned out today at Unilever&#039;s Rotterdam headquarters in the Netherlands to protest the world&#039;s third largest consumer products company&#039;s unrelenting shut-off of a final salary pension scheme for 5,200 UK workers. 
	 
	The manifestation, under the banner &ldquo;Unilever, Don&rsquo;t Make Workers Pay for Your Profits&rdquo;, saw representatives from no less than 23 European trade union organisations, as well as from the ICEM and the International Union of Food and Agriculture Workers&#039; Association (IUF). 
	 
	For three months now, Unilever has been trying to bully UK&#039;s Unite the Union, GMB, and the Union of Shop, Distributive and Allied Workers (USDAW) into conceding a final salary pension scheme, to replace it with an average career earnings pension plan effective 1 July 2012. Unilever CEO Paul Polman&rsquo;s 2010-11 salary and bonus pay-out equaled &euro;8 million, while Unilever&rsquo;s UK employees face a slash of between 20-40% on their pension earnings.

	At today&#039;s manifestation, led by Unilever&#039;s European Works Council (EWC), the European Mine, Chemical, Energy Federation (EMCEF), and the European Federation of Food, Agriculture, Tourism Trade Unions (EFFAT), rally leaders presented Unilever executive Rupert Chatwin with a declaration. 
	 
	In part, it read: &quot;We are very concerned that Unilever has been pursuing an approach of uncompromising unilateralism in the UK, which may be indicative of a change for the worse in Unilever&#039;s corporate culture. 
	 
	&quot;We believe that Unilever workers in Europe and around the world have good reason to fear for their futures. We have noted (CEO) Paul Polman&#039;s pledge to double Unilever revenue over the next ten years while promoting &#039;sustainable living&#039; but that he says nothing about sustainable employment.&quot;

You are on the front lines of what is just the beginning of bigger problems facing workers in Western Europe. 
	 
	&quot;The struggle you face in the UK is a struggle we must all tie into.&quot; 
	 
	Other speakers included EMCEF General Secretary Michael Wolters, EFFAT EWC and Transnational Companies&#039; Coordinator Simon Cox, as well as Unite Convenor Bill Hodgson from Unilever&#039;s Port Sunlight plant. 
	 
	Among some of the unions taking part: FNV Bondgenoten of the Netherlands, IGBCE of Germany, PRO-GE of Austria, FGA-CFDT of France, NGG of Germany, Petrol-Is of Turkey, FGTA-FO of France, FITAG-UGT of Spain, CGT of France, FLAI-CGIL, FAI-CISL and UILA-UIL, all of Italy, CNV of the Netherlands, and FGTB/ABVV of Belgium.

	The Rotterdam manifestation comes just days two weeks after Unilever posted a strong set of financial numbers in its latest results and three weeks after UK workers from several Unilever sites descended on Davos, Switzerland, where Polman served as one of the co-chairs at the World Economic Forum.

	Unilever UK management did finally agree to meet with the unions on 9 February with the assistance of UK&rsquo;s Advisory, Conciliation and Mediation Services (ACAS), but the company is still adamant on closing the final salary pension scheme effective 1 July 2012.

Spirited Rotterdam Rally Calls on Unilever to Save UK Pensions

	Some 25 trade union representatives from Indian states Maharashtra, Gujarat and Karnataka met at an ICEM workshop entitled &ldquo;International Labour Standards and Social Dialoguein Indian Chemical Industry,&rdquo; which took place on 15-16 February in Mumbai. The participants represented different chemical companies, including BASF (Mangalore and Thurbe plants), Rhodia, Reliance, 20-Microns, Shankar Packaging, FAG Bearing, NRC, Calchem, BEC Chemical and Danashmand and the ICEM workshop brought together different unions and national centers.

	Since 1990s, India has seen phenomenal economic progress with average 8% yearly GDP growth. This has made India 12th in the global chemical world and third-ranking in Asia. The chemical sector makes up 7% of India&rsquo;s GDP and 14% of total exports. The country also has emerging multinationals such as Reliance, Tata, Gujarat Chemicals, Biocon and Ranbaxyies.

	The Indian trade union movement, including chemical industry unions, face serious challenges such as declining union membership, shifts to unorganized and informal sectors, union multiplicity, low union density and weak finances. Indian union leaders inside the chemical industry say low wages and very long working hours are major problems.

	Contract and Agency Labour was defined as another major matter because chemical companies are using this social dumping practice widely. Workers employed in such regressive contracts generally get paid much less than workers directly employed with the primary employer.

	The meeting analyzed recent trends in the chemical industry through ICEM&rsquo;s viewpoint via its Director of Industry and Corporate Affairs, Kemal &Ouml;zkan, who provided wide information on employment characteristics in the sector. International labour instruments were also on the programme within the context of ICEM&rsquo;s Multinational Companies and Social Dialogue Project, coordinated by Yoon Hyowon.

	Ghosalkar Ravindra Govind, President of ICEM affiliate Chemical Mazdoor Federation (CMFI), stressed the importance of international cooperation for developing union work in India&rsquo;s chemical industry. &ldquo;At a time when our chemical industry grows, we must take all efforts to advance our members through the global support of ICEM,&rdquo; said the CMFI President.

	The participants discussed a road map for the future with special attention of enhancing union visibility, organizing contract and agency workers; enhancing union and social networking; establishing social dialogue mechanisms at various levels, and escalating campaigns for ratification and proper implementation of core labour standards.

	There was also wide common understanding among participants that the collective bargaining scale must be taken from plant level to sector level. It was unanimously agreed to continue such strategy meetings on a regular basis.

Chemical Unions in India Escalate Struggle for Decent Work

	On the evening of 12 February 2012, the President and General Secretary of the Coats Bangladesh Ltd. Employees Union went to the Coats Head Office at Novo Tower, Tejgaon Industrial Area, Dhaka in order to try to meet and discuss with company management with a view to resolving an industrial dispute.

	Instead of negotiating with the union leaders, company officials confiscated their mobile phones and forcibly detained them in their building overnight only releasing them when trade union colleagues alerted the local newspaper media of their disappearance.

	Management at the thread factory called Coats Ltd. in Bangladesh had failed to reach agreement with trade union negotiators. Having exhausted the bargaining procedures, a vote of the workers resulted in 98.12% in favour of strike action.&nbsp;The management somehow obtained a court order declaring the strike illegal.

	The workers at Coats Ltd. are paid poverty wages of only BD TK1,625 (US $18.90). The trade unions in Bangladesh consider BD TK7,000 to be the minimum that could be considered a living wage.&nbsp; During the negotiations, the local trade union negotiators reduced their demand from 100% to 30% pay rise.&nbsp;The union demands also included increases in housing and other allowances all of which were refused by the management negotiators.&nbsp; Despite trade union compromises the employer remained intransigent and refused to bargain in good faith.

	The Coats Employees&rsquo; Union is part of the Bangladesh Garments Textile &amp; Leather Workers Federation (BGTLWF), which is an affiliate of the International Textile, Garment, Leather Workers&rsquo; Federation (ITGLWF).&nbsp; The BGTLWF has called for solidarity from the wider trade union movement.&nbsp; The ITGLWF is preparing a complaint to the OECD Contact Point for the UK over the matter.&nbsp; Coats Plc. is based in the UK and is a leading global company that manufactures thread.

	The ITGLWF has written to Mr Paul Forman, CEO of Coats Plc. demanding that they intervene.

	Klaus Priegnitz, ITGLWF General Secretary, said to the Coats CEO, &ldquo;Your employees have clearly been mistreated and exploited for some considerable time.&nbsp; Theunion hasacted responsibly and with restraint in pursuing their justifiable and moderate demands.&nbsp; We call on you to instruct your local management to engage in constructive dialogue with the local trade union with a view to resolving this dispute on terms which are acceptable to the workers.&rdquo;

Bangladesh Union Leaders Held Captive by Factory Managers

	Over 140 paper packaging workers have been taking strike actions against the Austrian company Mayr-Melnhof at a food packaging plant in Bootle, near Liverpool. The industrial actions, which began 12 days ago, revolve around management&rsquo;s stubbornness over redundancy terms.

	UK&rsquo;s Unite the Union is leading the strike actions, which last weekend, 18-19 February, took a different turn when management locked workers out of the factory. The purpose evidently was so managers could move products and equipment to another plant. Workers responded to the lockout with a blockade, and demanded to meet with management. Those talks commenced earlier this week.

	The Vienna-based company had sought paring 49 staff at the 180-worker factory, but the union agreed to significant changes to terms and conditions to reduce the redundancy count to 37.

	But talks broke down and workers voted for strike action in a ballot counted on 3 February. Mayr-Melnhof refused to lower the number and became miserly in awarding proper social terms and conditions.

	Unite has called it &ldquo;switch strikes.&rdquo; Workers first took strike action at midnight on 9 February, and then again the following week on 13 and 15 February, with weekend plant-gate demonstrations in between. Those were six-hour rotating strikes from 06h to noon, and then from noon to 18h. Workers were planning further actions last weekend when they faced the lockout.

	&ldquo;This is not the action our members wanted to take, but they felt they had no alternative,&rdquo; said Unite Regional Officer Phil Morgan. &ldquo;The redundancy terms on the able are significantly inferior to terms negotiated on previous occasions.&rdquo; The company had previously laid off about 50 workers and the reduced severance packages this time induced none of the workforce to apply for voluntary redundancy.

	Mayr-Melnhof makes several kinds of food packaging at Bottle ranging from tea bags to breakfast cereal to packaging for pet food. The firm operates another UK facility in Deeside, North Wales.

	Turkish workers of rubber manufacturer Standard Profil, organised by ICEM affiliate Petrol-İş over a year ago, are more determined than ever to get a collective agreement from a recalcitrant employer. On 2 April, some 500 workers gathered with union President Mustafa &Ouml;ztaşkin outside plant gates in the northern Anatolian city of D&uuml;zce to publicly state that union and workers will not be deterred in gaining their universally recognised collective bargaining rights.

	The ICEM as well joined the demonstration, the first such outward display by workers amidst a climate of management fear and intimidation, and promised that pressure will continue against the private equity firm that controls Standard Profil, a maker of weather-sealing door and window units for the automotive industry.

	ICEM&#039;s Dick Blin Displays Alert to a Company Customer

	The rally saw a number of Anatolian labour leaders participate along with &Ouml;ztaşkin, Petrol-İş Organising Secretary Nimetullah S&ouml;zen and regional Organiser Ǘnal Akbulut. Gathering under the banner &ldquo;One Year is Enough: Standard Profil Workers Are Unionised &ndash; They Want Their Right to Collective Bargaining,&rdquo; the manifestation was conducted under the watchful eyes of managers who dispatched transport buses through in an effort to disrupt it.

	Following a Petrol-İş organising drive from December 2010 to February 2011 that saw well over half of 2,300 workers from the plant in D&uuml;zce and a sister factory in Bursa select the union as their bargaining representative, Turkey&rsquo;s Labour and Social Security Ministry in March and April 2011 formally granted a pair of certifications stating Petrol-İş was both the correct sectoral union &ndash; rubber &ndash; for Standard Profil workers, and that it had exceeded the simple majority needed for representation.

	Despite Petrol-İş and ICEM invitations to both Istanbul executives of Standard Profil and the UK-based private equity firm to form a positive labour-management relationship, the company chose an adversarial path by wasting company funds in legal challenges to both certifications in an effort to block workers from their legitimate workplace rights.

	Standard Profil managers further muddied the waters by sacking 37 union activists inside the larger D&uuml;zce factory, a grievous factory-level ploy to intimidate others against the union. Judging from Monday&rsquo;s determined and vocal manifestation, workers are not intimidated. But they are growing short of patience with management&rsquo;s stalling strategy through frivolous legal appeals.

	One Year is Enough&nbsp;

	Petrol-İş President &Ouml;ztaşkin made it clear at the one-year anniversary that a new era has now begun. The union will move in a different direction to get Standard Profil to the bargaining table. &ldquo;We cannot and will not accept this employer&rsquo;s attempts to block the internationally rights and freedoms of workers,&rdquo; he said.

	The ICEM has begun to take the rights abuses outside Turkey. Standard Profil&rsquo;s major auto-making customers have been identified and efforts are underway to alert trade unions and automotive factory managements of the company&rsquo;s dereliction. In some instances, Volkswagen/Audi and Daimler for instance, global labour pacts contain strict guidelines that suppliers must comply with basic workplace rights.

	The rubber manufacturer&rsquo;s assets are controlled by Bancroft Private Equity LLP, a holding company that has been trying to dispose of Standard Profil since last year. The ICEM has made it clear to Bancroft &ndash; and to the buyers of Standard Profil&rsquo;s products &ndash; that a positive and respectful labour relations bond with Petrol-İş is far better than an adversarial one to ensure a productive and profitable future for the auto supply company.

One Year On, Turkey’s Standard Profil Still Delays Workers’ Bargaining Rights

	What does precarious work look like in Australia?

	One of the things that has characterised clothing workers in Australia over many decades has been that companies manufacture goods through very long, complex and broad supply chains. The supply chains in numerous cases have multiple levels and often at the end of those supply chains you find someone working at home &ndash; these are predominantly women, mainly migrant women in the Australian context; they don&rsquo;t have English as a first language and they are working in very isolated circumstances; they commonly work 7 days a week and when there&rsquo;s a rush for orders they&rsquo;ll work throughout the day and night. It&rsquo;s also common that they&rsquo;ll involve other family members including children to try to get the work done and part of the other aspect that characterises these workers is that they&rsquo;re often told that they&rsquo;re not employees, that they&rsquo;re not workers, and the people who give them the work require them to have some sort of company name or corporate structure to be able to give them the work. This is a sham arrangement &ndash; they&rsquo;re not genuine contractors and have no genuine independence at all. This is an attempt by the company and the brand to distance themselves from their employment responsibilities.

	What action has the Textile, Clothing &amp; Footwear Union of Australia taken?

	More than 20 years ago we succeeded in having a legal set of award conditions that said that if you are a worker in a factory in our industry or at home you are entitled to the same pay and conditions &ndash; this along hasn&rsquo;t fixed the problem. So, what we are now doing &ndash; and have had some success &ndash; is with different state governments in Australia introducing state legislation.

	Our unions campaigned for many, many years on this issue, and we don&rsquo;t do it alone we&rsquo;re part of a broader campaign called the &lsquo;Fairwear&rsquo; campaign which is&nbsp; made up of unions, church groups, student groups, community organisations and activists who for more than 15 years have had a campaign which focuses publically on companies who don&rsquo;t take seriously their responsibility to workers in their supply chains, and pressures them to become accredited with a voluntary scheme which makes the whole supply chain transparent. The accreditation scheme is based on Australian legal minimum standards being met, so through the campaign and the unions&rsquo; exposure of many examples of exploitative behaviour of workers working from home we got some state governments to introduce laws and now we&rsquo;re just at the point of having the federal government introduce a national legislation which picks up on what we achieved at the state level and makes it nationally consistent. It&rsquo;s now gone into the Australian Parliament and will be voted on in the next couple of weeks.

	The proposed legislation does 4 keys things. The first thing is it deems all outworkers &nbsp;(our terminology in Australia for these workers working at home is outworkers)&nbsp; to be employees, it says regardless of whether you are required to have a business name or company structure you are an employee. Secondly, it allows those workers to recover unpaid money up the supply chain, so if the person who gave them the work disappears they can go to the next company up the supply chain, or the next company above that, to recover unpaid wages and it includes the notion of the &lsquo;apparent employer&rsquo; so it allows you to recover money from the apparent employer as opposed to only the actual employer. The third thing it does is allow the government to introduce a mandatory code to complement the voluntary code that I spoke about before, and that mandatory code would put obligations not just on the manufacturers but on the retailers &ndash; so it would require retailers by law to make their whole supply chain transparent. The forth thing it does is gives the union greater right of entry powers &ndash; not into homes, we already have right of entry powers in relation to the records etc. about homeworkers and we don&rsquo;t want to be able to enter into someone&rsquo;s home without their permission, but it gives us far greater powers to enter what we describe as sweatshops than apply to most other unions under Australian law - most other unions under Australian law have to give 24 hours&rsquo; notice of entry, and are only able to look at their members&rsquo; records. What this law will do is allow us to not give any notice so we&rsquo;ll be able to go straight into the workplace without giving them any prior notice, and it will also allow us to check all of the workers&rsquo; records, not just the union members.

	How does your union organise homeworkers?

	We&rsquo;ve tried a variety of different methods and are still trying new things all of the time because they are, from our experience, the hardest group of workers to organise. Because of the level of pressure that they&rsquo;re placed under they are very fearful of seeing to be associated with the union, otherwise they lose work. But the method where we&rsquo;ve had some success is that for&nbsp; many years we&rsquo;ve run free English language classes that are targeted to outworkers in their community so in the regions and suburbs that they live in. Those classes deal with English languages and literacy, but also with rights and the role of the union. We also visit workers and try and establish new networks of connecting these workers, often using social occasions as a way of bringing workers together. One of the things that characterises this work is that it is really isolated so we try and find opportunities to bring them together. We do things like a trip to a garden show &ndash; a range of activities where they and their children can come. The other thing we do is employ organisers who have done outwork themselves and also speak the language &ndash; the majority of these workers currently are Vietnamese, so we&rsquo;ve got a strategy of employing Vietnamese organisers in the union that can deal directly with people in their first language and also organisers who have had the experience of doing that sort of work themselves.
