ICEM affiliate Ghana Mine Workers Union (GMWU) successfully brought 600 new members into its fold recently. Senior staff at AngloGold Ashanti&rsquo;s Obuasi Mine joined the GMWU, and will become the Professional and Managerial Staffs Union of the GMWU. 
 
At an inaugural event on 5 October, Ghana Trade Union Congress General Secretary Kwasi Adu-Amankwa called the integration a milestone event for the 65-year-old GMWU, a union, he said, that has dramatically improved work conditions and community life in Ghana&rsquo;s gold belt.

GMWU General Secretary Prince William Ankrah stated that having senior staff in the union will go far in healing the colonial legacy of the 50-year-old west African nation that once saw senior and junior workers pitted against one another by the divide-and-rule dictums of labour relations by mining companies. 
He welcomed the senior staff of the South African-based company into the GMWU, stating they will now be offered the same excellent services built over many years, including job security, career development, dependent educational opportunities, and other social programmes. 
 
The Obuasi Mine is AngloGold&rsquo;s most productive of three mines in Ghana, and the only one that is underground. Gold mining, which accounts for 30% of all revenues derived from the country&rsquo;s exports, occurs at 1.6 kilometres deep at Obuasi, with a current project now underway to dig deeper, expecting to extend the mine&rsquo;s life span beyond the year 2040.

This mine was the major catalyst behind the 2004 merger of AngloGold and Ashanti Goldfields of Ghana. The company also operates open cast mines at Iduaprim and Teberebie. With several other gold producers operating in Ghana, including Goldfields, Newmont Mining, Red Back Mining, and Golden Star of Canada, the country is Africa&rsquo;s second largest gold producer behind South Africa. 
 
The Professional and Managerial Staff of GMWU has an eight-member executive, including Chairman Seidu Adam Bogobiri, Deputy Chairman Charles Owusi, Secretary Samuel Dwamenah, Deputy Secretary Isaac Newton Kusi, First Trustee Collins Ankomah, Second Trustee Eric Obeng Foshuhene, Chaplain M.C. Turkson, and Women&rsquo;s Representative Doris Apem.

Ghana Mine Workers&#039; Union Organises Senior Staff of AngloGold Ashanti

ICEM principals and leaders of French chemicals company Rhodia journeyed to China from 8-12 October, as part of monitoring the Global Framework Agreement between the company and the Global Union Federation. Rhodia operates two plants in China and the purpose of the visit was to inspect working conditions in the plants, as well as work terms. 
 
General Secretary Manfred Warda and Chemicals and Rubber Officer Kemal &Ouml;zkan represented the ICEM, while Rhodia&rsquo;s CEO Jean-Pierre Clamadieu, Sustainable Development Director Jacques Kheliff, and Group Vice President of Corporate Communications, Lucia Dumas, represented the company.

The delegation met with Chinese leaders of the company at Rhodia&rsquo;s regional headquarters in Shanghai, toured plants in Lyang and Zhenjiang, and met with chemical, energy, and mine leaders of the All China Federation of Trade Unions (ACFTU) in Beijing. 
 
China leads Rhodia&rsquo;s Asia-Pacific region in sales growth, which, in total, gives the company &euro;938 million of its sales. Korea comes second, while Japan is third. 
 
In Shanghai, the ICEM learned that all Rhodia workers have written individual contracts, and, in the plant in which the ACFTU is present, a collective agreement is in place. That agreement is not negotiated, but rather only signed by the official ACFTU representative in the plant. The ICEM was critical of this, but company officials did state a willingness to engage with a partner representing all workers&rsquo; interests in negotiations. 
 
The Lyang plant, which produces chemicals for the auto and electronics industries, is now 95% owned by Rhodia and employs 570 workers, of whom 350 have signed long-term employment contracts. The ACFTU&rsquo;s Chemical, Energy and Mine Workers&rsquo; Industrial Union is active in the plant. 
 
The Zhenjiang plant is currently just going on-line with 67 workers, the majority of whom are engineers. It is a diphenols plant, using Rhodia technology to produce non-chlorinated guaiacol for the food industry. Since it is currently in start-up phase, there is no union present. At both plants, located in Jiangsu province, ICEM and Rhodia officials were informed about products, technology, safety, health and environmental matters, salary and social benefits, staffing, and local community relations.

On the final day of the visit, the delegation met in Beijing with leaders of the ACFTU and Chemical, Energy, and Mine Union, through arrangement with the local office of Germany&rsquo;s Friedrich Ebert Foundation. The session was attended by ACFTU&rsquo;s deputy chair of the International Department, Zhang Tao; Jia Ziaodong, president of the 15-million-member Chemical, Energy, Mine Union; and Qingyi Li, ACFTU&rsquo;s officer for European Affairs. 
 
A main point of discussions was China&rsquo;s new labour contract law &ndash; to be effective on 1 January 2008 &ndash; and a law which the Chinese labour federation strongly supported and had great input on. The ACFTU criticized the US Chamber of Commerce for standing firmly against enactment of the law, and ICEM&rsquo;s Warda outlined the ICEM position. 
That stance, adopted at the May 2007 Executive Committee, stated some multinational companies from developed nations were working against adoption of the law, which gives some semblance of workplace rights and job security to Chinese and migrant workers. Rhodia senior officials at the meeting said the company supported enactment. 
 
A meeting at the French Embassy in Beijing concluded the final day of the visit.

ICEM, Rhodia Conduct Work Visit to China as part of Global Framework Agreement

The National Union of Mineworkers (NUM) petitioned South Africa&rsquo;s Commission for Conciliation, Mediation and Arbitration (CCMA) last week to conduct a one-day strike. The strike would call attention to severe safety deficiencies by mining houses operating in South Africa in the wake of the near catastrophe at Harmony Gold&rsquo;s Elandsrand Mine on 3-4 October. 
 
Some 3,200 miners were trapped there when a piece of steel pipe dropped 2.2 kilometres down an elevator shaft, severing electrical cables and shattering the framework of the mine&rsquo;s main elevator. Fortunately, all were rescued, but it took the company 38 hours to complete the rescue.

But even after that near tragedy, the death toll in South African mines&nbsp;has risen. On 10 October, three miners were killed at Goldfields Kloof gold mine near Westonaria when a rope hoisting a skip loaded with rock snapped, sending the load back down a shaft and crushing the three miners. On the same day, another Goldfields miner was killed by falling rock 2,700 metres underground at the company&rsquo;s South Deep Mine. 
 
Three NUM members at Northam Platinum in Thabazimbi lost their lives in accidents recently. The NUM said the company had failed to report the deaths. The company responded by stating that its policy has been not to report single fatalities. On 17 October, one miner at AngloPlatinum&rsquo;s Paardekraal Mine in Rustenburg perished and another was critically injured and remains hospitalised from an underground rock fall. 
 
A day earlier, Reuters in Johannesburg reported that the subsidiary of Anglo American was contemplating reducing the number of contract workers in its mines because the safety record of such workers is not as good as for permanent staff. &ldquo;We have identified this as the key challenge,&rdquo; stated AngloPlats head of Strategy, Frances Petersen.

The NUM formally applied to the CCMA for a certificate to strike on the same day of the AngloPlats Rustenburg tragedy. The strike could come as early as next week, or the first week of November. It would mark the first time in 20 years that the ICEM affiliate took strike action across the country&rsquo;s entire mining sector.
In a statement, the NUM said a &ldquo;genocide is unfolding, and the NUM is preparing for a strike that seeks to divert attention from the obsession with production targets to the one that deals with realising the sacrosanct human life.&rdquo; 
 
NUM General Secretary Frans Baleni added that the loss of black miners has come at the expense of enormous profits made through continuous operations.

Fourth ICEM World Congress - Draft Congress Agenda

Following overwhelming rejection of a collective agreement proposal on 28 September, 500 members of New Zealand&rsquo;s Engineering, Printing, and Manufacturing Union (EPMU) have put off industrial action late last week after the plastic employers&rsquo; association promised to improve their offer.

EPMU National Industry Officer Rachel Mackintosh said the decision to call off the strike was taken reluctantly, but employers pledged in talks late last week to revise the offer to include added leave time and recognition for long-time service. &ldquo;At this stage, we don&rsquo;t know the details of the offer, but the heat is on the employers because they know we&rsquo;re determined to see this through and get a fair deal,&rdquo; said Mackintosh. 
 
She said the union&rsquo;s bargaining committee for plastics thought it was important to give bosses one further opportunity to include added leave time in a new proposal. The EPMU represents plastics manufacturing workers of 13 companies at 16 worksites.

On 28 September, 81% of the workers voted to reject a prior industry offer based on the failure to address their service leave claim. They also endorsed a resolution to engage in industrial action. In the first two weeks of September, EPMU members in plastics manufacturing had rejected an earlier employers&rsquo; proposal. 
 
EPMU members in metal sector bargaining won an extra week&rsquo;s leave in that set of talks in 2007, and plastics workers of the EPMU are adamant on posting the same gains.

Plastic Manufacturing Strike in New Zealand Averted for Now

Three US congressional members from the US House of Represents have written to American management of Continental AG, asking that they rescind the deep medical cuts made to a retirees&rsquo; health care plan when the company closed tyre plants in the US. 
 
Linda S&aacute;nchez (California), Stephen Lynch (Massachusetts), and Michael Michaud (Maine), members of the Labor and Working Families Caucus of the US Congress, called on the German company to &ldquo;promptly fulfil Continental&rsquo;s contractual obligations to retired workers.&rdquo;
The letter was on behalf of ICEM affiliate United Steelworkers (USW), which has pressed through court and other actions that Continental&rsquo;s unilateral change to the health care plan was illegal. Effective 1 March 2007, the rubber maker imposed a US$3,000 annual cap on health care payments for each of 2,500 retired Conti workers and dependents. The USW contends that some retirees now must pay up to US$12,000 per year in out-of-pocket money to cover their health care needs.

On 31 July 2007, a US federal district judge, in a summary judgement in the state of Ohio, ruled that Continental had illegally reduced the benefit levels for retirees and dependents, stating the company must fulfil its contractual obligations with the USW over health care premiums and funding. Continental Tire of North American, the US subsidiary, immediately filed an appeal to that judgement in another US court. 
 
The decision to appeal and delay rightful health care benefits was a blow to former Continental workers in Charlotte, state of North Carolina; Mayfield, state of Kentucky, and Byron, Ohio, where, in 2006, they had already been victims of Continental plant closings. 
 
The US elected representatives, speaking out for fairness and justice, told Continental that its practices were having a devastating impact on its American retirees. The letter stated that considering the 30-plus years of dedicated service by former Continental employees performed, as well as the extraordinary health hazards inside the tyre industry, it is hard to understand the inadequate health care benefits these retirees now receive.

US Congress Members Urge Continental AG to Rescind Retiree Health Care Cuts

A year ago, Michelin rubber company announced a massive, global four-year restructuring plan called l&rsquo;Horizon 2010. The plan would cut costs by over US$2 billion by 2010, push the operating margin to over 10%, and gain annual growth at a rate of 3.5%. 
 
It would also cost 12,000 jobs, nearly two-thirds of which are now happening in France, Spain, and Italy. The horizon for many European workers of Michelin is bleak and barely visible. 
 
In France, trade union CFDT has expressed deep concern over the French company&rsquo;s plan to close its auto and light truck tyre plant in Toul, an enterprise called Pneumatiques Kleber. The plant is located in Meurthe-Moselle near Metz. Michelin intends to close the 47-year-old plant by 2009, severing 800 jobs. 
In Spain last week, CC.OO trade unions conducted a vote among 5,500 Michelin workers at three tyre plants on a company-proposed plan tied in with l&rsquo;Horizon 2010. The plan passed by just under a two-to-one margin, but job restructuring will occur for half of the workers. Even though changes to work shifts are now in effect, Spanish unions did maintain the 35-hour work-week, and work days will not exceed 198 annually.

The tyre plants are Michelin&rsquo;s Valladolid auto and tractor tyre plant, an auto and construction tyre plant in Vitoria, and a truck and bus factory in Aranda de Duero. The plants are in northern Spain. Workers at a fourth tyre plant in Lasarte, near Bilbao and close to the Bay of Biscay coast, won assurances that Michelin will invest US$73 million to produce premium tyres for sport motorcycles. 
 
In Italy, trade unions FILCEM-CGIL, FEMCA-CISL, and UILCEM-UIL began protests in June to protect 5,500 jobs at four production plants, all near Turin, three logistic plants, and a commercial centre in Milan. The unions have demanded that the multinational begin new investments in the country, and have called upon Italy&rsquo;s Ministry of Economic Development to closely examine issues that will facilitate investment. 
 
Michelin&rsquo;s ambitious four-year restructurings call for reducing inventory levels below 16% of net sales, freeing cash flows, and spending some US$650 million per year on capitalisation projects, nearly all of which will occur in Eastern Europe, Asia, and Latin America. 
Besides Europe, workers in other countries have felt the pain of job cuts and plant closings. Early in 2007, in Nigeria, the French company closed a tyre plant in Port Harcourt, causing Nigeria&rsquo;s senior staff federation, Trade Union Congress (TUC), to say that it &ldquo;wonders why (Michelin) just wants leave of the country, causing misery and hardship to former employees who never prepared for premature retirement.&rdquo; The plant employed 1,200, and Michelin had operated it for 30 years. 
 
In North America, Michelin shuttered a unionised plant in Kitchener, Canada, in 2006. The closure cost 1,100 jobs in the province of Ontario. The United Steelworkers (USW) protested the closure several times, including a mass rally when the plant&rsquo;s machinery was auctioned off in May 2007. 
 
That same month, in the UK, Michelin announced it was closing its final pension scheme for 4,000 rubber workers at three plants and a logistics centre. The company said it was moving workers into a defined contribution pension plan, effective in January 2009. Three years ago, Michelin closed off the final pension scheme to all newly hired employees at its UK operations.

Michelin’s 4-year Restructuring Plan Causing Pain in Europe

ICEM&rsquo;s two Nigerian oil and gas workers&rsquo; unions, NUPENG and PENGASSAN, gave the government and an energy company a two-week ultimatum on Friday, 5 October, or face a strike. The blue-collar and white-collar unions are fast losing patience with Conoil-Belbop Ltd., a publicly-listed Nigerian company engaged in oil and gas exploration, as well as petroleum products marketing.
The unions are pressing the government to force the company to comply with terms of a 2005 collective agreement, or face a national strike in the industry.

Salaries by the company have not been paid since August 2007, and Conoil-Belbop has sacked nearly all union members inside its 300-member workforce in a reorganization of the joint companies. The company is attempting to recruit new employees. 
 
In late 2006, the company arbitrarily and unilaterally reduced salaries by 30%, and refused to conclude talks earlier in 2006. The unions also accuse the company of unethical distribution of redundancy letters. NUPENG and PENGASSAN have already placed an embargo on all work at Conoil-Belbop. 
 
At a joint press conference on 5 October, PENGASSAN President Peter Esele said, &ldquo;It appears the embargo is not enough to make Conoil behave properly, and so we are taking it to a different level.&rdquo; The two unions called on the federal government and the ministers of labour and energy to immediately intervene.
The company&rsquo;s continued efforts to circumvent the unions are directly contrary to an order issued by the National Industrial Court in June 2007. Conoil is the marketing and distribution arm of the Lagos-based company, while Belbop is engaged in services related to oil and gas exploration.

In other Nigerian news related to PENGASSAN, the senior staff union held a three-day workshop in Calabar, Cross Rivers state, over the weekend of 1-3 October. A statement from the workshop calls for a national summit as the means to resolve the ongoing crisis in the Niger Delta. 
 
Entitled &ldquo;Fostering Congenial Industrial Climate in the Nigerian Oil and Gas Sector: Challenges and Strategies,&rdquo; the statement calls on the government to wage a genuine fight against corruption in all facets of life, to give strict adherence and implementation of proposed Memorandums of Understanding with local communities, begin real infrastructure development, and to engage in youth empowerment projects. 
 
&ldquo;The workshop is concerned about safety and security of oil workers and other stakeholders in the Niger Delta,&rdquo; said PENGASSAN Acting President Mustapha Wall and General Secretary Bayo Olowoshile in a statement. &ldquo;The workshop agrees that underdevelopment, unemployment, corrupt activities of the local and political class, conflict merchants, and lack of political will by the ruling class contribute&rdquo; to the denigration of society in many areas of the Niger Delta.

Nigerian Oilworkers Ready for National Strike Due to Harsh Practices of Conoil-Belbop Ltd.

Strong, last-minute arm-twisting by the US government apparently proved effective, as Costa Ricans went to the polls yesterday, 7 October, in a referendum on ratification of the Central American Free Trade Agreement (CAFTA) with the US. With over 90% of polling complete early on Monday, the &ldquo;yes&rdquo; vote has gained just over 50%, while those voting against tallied 47.6%. 
 
Some 60% of Costa Rica&rsquo;s 2.6 million voters turned out for Sunday&rsquo;s balloting. A 40% turnout was needed to make the plebiscite legally binding. Costa Rica was the only one of six Latin countries to put ratification of CAFTA before voters. Earlier, the governments of the Dominican Republic, El Salvador, Guatemala, Honduras, and Nicaragua ratified CAFTA, which will open trading markets between the countries and the US. 
 
On Saturday, the Bush administration issued a terse warning to Costa Rica&rsquo;s citizens, stating that if ratification did not occur, it would not extend existing preferential tariffs on certain goods traded between the two countries. The US government also said under no circumstances would it re-negotiate the trade agreement with Costa Rica.

In polls taken as late as the middle of last week, proponents of a &ldquo;no&rdquo; vote, led by unions and others under the banner &ldquo;Patriotic Movement Against FTA and US,&rdquo; were leading in polls, with upwards of 55% of Costa Ricans saying they would reject the plan. The opponents, including national labour centres Central del Movimiento de Trabajadores Costarricenses (CMTC) and the Confederaci&oacute;n de Trabajadores Rerum Navarum (CTRN), have been deeply suspicious of the US-prescribed trade and privatisation agreement. 
 
Specifically, they expressed concern over a flood of cheap US food products entering the country. Opponents also cited privatisation of Costa Rica&rsquo;s state-run telecommunications company, the country&rsquo;s insurance services, and its agriculture industry. 
 
In the waning days of the campaign, however, besides the campaign interference by the US government, President Oscar Arias &ndash; a proponent &ndash; termed a &ldquo;no&rdquo; vote as &ldquo;collective suicide.&rdquo; Two month&rsquo;s before Sunday&rsquo;s vote, a high-level memorandum from top aides of Arias was leaked that outlined a dirty tricks campaign against the &ldquo;no&rdquo; faction. The memo caused the temporary resignation of Second Vice President and Planning Minister Kevin Casas.

Costa Rica Narrowly Passes Free Trade Pact in 7 October Balloting

Three weeks after suspending a scheduled 12 September strike, 2,000 copper mining and smelting workers in Peru downed tools on 2 October in an indefinite strike. The strike, against Grupo M&eacute;xico&rsquo;s Southern Copper Corporation, came after the mining and metals federation &ndash; ICEM affiliate FNTMMSP &ndash; halted strike action after miners voted on 11 September to give government mediated talks a chance to work. 
 
Following the start of last week&rsquo;s strike, the FNTMMSP called on Labour Minister Susana Pinilla to quicken the dialogue in order to find solutions to unresolved issues. FNTMMSP will mobilise toward a national strike across the mining sector on 5 November unless issues get resolved at Southern Copper and other mining enterprises.

The strike by Peruvian miners at troubled Grupo M&eacute;xico instantly raised copper prices nearly 1% on world markets. The strike occurred at Southern Copper&rsquo;s Toquepala and Cuajure mines, and at its Ilo smelter. Workers are demanding a fair pay package of 11%, while Grupo M&eacute;xico seeks longer shifts and proposes a pay offer of less than half of what the union seeks. The company predicts a strike of any duration will cause 2007 production losses to exceed 10%. Southern Copper produces 370,000 tonnes of copper annually from its Peruvian operations. 
 
Southern Copper&rsquo;s miners took short strike actions in May and June of this year. The company&rsquo;s chief attack has been to file charges with the government claiming the strikes are illegal.

Grupo M&eacute;xico is also fighting miners in Mexico. Since 30 July, Mexican mining and metals union, SNTMMRM, has been striking three operations of the company, including the Cananea copper mine in northern Mexico, near the US border. The other two mines are a silver, lead, and zinc mine, near Taxco in Guerrero state, and the San Mart&iacute;n zinc mine in Zacatecas. 
 
Mexican miners are striking over demands for collective agreements, and better health and safety conditions. Grupo M&eacute;xico has responded by announcing mine closures, citing depletion of resources, and seeking to declare the strikes illegal.
